        <![CDATA[<p><strong>Authorities Alerted By Screaming and Gunfire</strong></p>
<p>An ugly domestic situation drew the attention of police on Sunday, ultimately leading to the arrest of Courtney Wagner. Wagner, 38, is the daughter of one of Hollywood's most famous couples, Natalie Wood and Robert Wagner. Wood drowned in 1981 in a sailing accident with her husband, Robert, and co-star, Christopher Walken. The details of how she drowned remain a mystery.</p>
<p>Law enforcement officers were alerted to a disturbance at Courtney Wagner's Malibu house after a neighbor reportedly heard a woman's screams followed by a gunshot. Shortly after arriving, police discovered cocaine and heroin on the premises and immediately arrested Wagner on suspicion of felony <a href="http://www.danielperlmanlaw.com/Drug-Crimes/Drug-Possession.shtml">drug possession charges</a>.</p>]]>
        <![CDATA[<p>Although nobody appeared to have been injured from the gunshot, Wagner's companion, an unidentified male, was arrested and charged with negligent discharge of a firearm.</p>
<p>Wagner has posted $10,000 bail and has refused calls for comment on her arrest. If convicted, the screen siren's daughter could face serious penalties. A felony <a href="http://www.danielperlmanlaw.com/Drug-Crimes/Heroin-Charges.shtml">heroin charge</a> may make Wagner ineligible for treatment or diversion programs as an alternative to time in prison.</p>
<p><strong>Heroin Returns to Center Stage </strong></p>
<p>Heroin has regained prevalence over the past few years as prescription opiate addicts turn to it as a cheaper and more accessible alternative to the painkillers OxyContin and Vicodin.</p>
<p>Wagner's associate with heroin may be an indication of deeper troubles. Unlike other recreational drugs, such as marijuana, heroin is known for its devastating addictive properties. The potency of the drug increases the chance of an accidental overdose.</p>

        <![CDATA[<p>Friday's arrest of Nickelodeon star, Amanda Bynes caught many people off guard. The actress, who famously tweeted that she was giving up acting at the age of 24 only to recant a month later, was arrested under suspicion of <a href="http://www.danielperlmanlaw.com/DUI-Defense/">driving under the influence (DUI)</a> shortly after leaving the Greystone Manor nightclub Friday night.</p>
<p>According to sources, 26 year-old Bynes started off the evening having a pleasant dinner at the Standard Hotel. Although she was observed drinking, the source did not believe that she was intoxicated. She then moved to the Greystone Manor nightclub, where she stayed until after midnight.</p>]]>
        <![CDATA[<p>Bynes was held overnight at the West Hollywood police station before being released.</p>
<p>Although Bynes has only been charged with a misdemeanor, it appears people in Bynes' camp are taking the charges seriously. A source told People magazine that Bynes' DUI arrest reflected a "serious lapse in judgment," on the part of the actress.</p>
<p>Bynes' father, Rick, was more defiant and came to his daughter's defense, telling reporters that Bynes wasn't intoxicated but was simply "upset and very emotional." He also claimed that his daughter doesn't drink.</p>
<p>Many believe Bynes' arrest may have grown from her professional troubles. The actress has struggled since 2008 and some believe she may have lost her way.</p>
<p>The fresh-faced actress may be on her way sooner rather than later. Not only does the arrest mark her <a href="http://www.danielperlmanlaw.com/DUI-Defense/First-Offense-DUI.shtml">first DUI offense</a>, but there are no published accounts disclosing the actress' blood alcohol content (BAC). The results of her BAC could prove critical in her defense.</p>

        <![CDATA[<p>Aspen prosecutors have formally charged Brooke Mueller, the ex-wife of Charlie Sheen, with felony cocaine possession with the intent to distribute. The charges stem out of the alleged actions of the former actress on the night of December 2, 2011 when she supposedly assaulted a woman. Later that night, she was arrested by Aspen police.</p>
<p>Prosecutors seem intent on making <a href="http://www.danielperlmanlaw.com/Drug-Crimes/Drug-Possession.shtml">drug possession</a> charges stick to the actress. To eliminate a potential defense regarding the quantity of the drug, the prosecution has charged Ms. Mueller with one count of possessing over 4 grams of cocaine as well as one count of possessing under 4 grams of cocaine.</p>]]>
        <![CDATA[<p>If convicted, Mueller could face serious penalties. If Mueller is found guilty of possessing the larger amount of cocaine, she could be sentenced to as much as six years in prison. On the other hand, if convicted of possessing the smaller amount, her sentence could be much lighter. She could be ordered to serve an 18 month sentence.</p>
<p>Once Mueller's case is put in perspective, people believe it is unlikely she would either of these sentences. Because Mueller has no prior drug charges, it is more likely that she would receive probation.</p>
<p>Probation assumes Mueller is convicted or accepts a deal.</p>

<p>It is widely speculated that the singer/actress who fell from stardom died from an overdose on February 11, the actual cause of death has yet to be released.&nbsp; According to the Associated Press, the star was found in her bathtub at the Beverly Hills Hilton on Saturday afternoon and while no indication of foul play has been speculated about, an autopsy was performed by the medical examiner's office and the results are still pending.</p>

<p>It is not uncommon, particularly where celebrities are concerned for controlled substances to be suplied by friends or in the case of deaths like Michael Jackson or Anna Nicole Smith, their trusted physicians.&nbsp; Here, Whitney came for Grammy weekend and was, in the words of friends, "not protected" from those who might try to get her high.&nbsp; If the post-mortem indicates a drug overdose, it may harken back to John Belushi's death in 1982 where Catherine Smith was charged with murder for giving Belushi his fatal "speedball shot"</p>

<p>Despite being mostly out of the public eye for a few years, and much longer in a positive light, the media has made a circus over Whitney's death and "star-studded" and drama filled funeral with former husband Bobby Brown making an entrance and early exit.&nbsp; With the media hungry to increase the drama, speculation of a criminal twist will send the likes of E!, TMZ and Nancy Grace into a tizzy.</p>

<p>Whomever is responsible could find themselves facing <a title="Defending Murder Charges in Los Angeles" href="/Violent-Crimes/Murder.shtml">murder </a>or manslaughter charges in addition to <a title="Defending Drug Charges in Beverly Hills" href="/Drug-Crimes/">drug charges</a> in Los Angeles Superior Court in Beverly Hills and as important, a tremendous challenge in deciding who to trust in the media and amongst the hungry pack of attorneys who would likely rush to their "aid."</p>

<p>The prosecution rested today in this famed case of college love gone wrong in Virginia.&nbsp;</p>

<p>The updates of the court case can be found all over the media.&nbsp; What I want to focus on briefly is how easily George Huguely could have protected himself from what now appears to be an easy conviction.&nbsp;</p>

<p>Two rules which I will follow up on in the coming days:</p>

<p>1. Don't Talk To The Cops!&nbsp; EVER!</p>

<p>2. Don't make up stories/lies - even to friends - they might testify against you in the future</p>

<p>If George did commit this act intentionally and the regretted it, we'll never know.&nbsp; From facts now known, it is clear that she died in relation to their physical altercation.&nbsp; What we do not know for certain is whether he intended to kill her or whether he knew she was seriously injured and thereby needing medical attention when he left her that night.&nbsp; From a defense perspective, I am concerned that George's team-mates/friends testimony about his mood and lies spell guilt to the jury more than anything else presented by the prosecutors.</p>

        <![CDATA[<p>A 61 year-old South Los Angeles teacher, identified as Mark Berndt, was arrested Monday and charged with 23 counts of performing lewd acts upon children, whom attended the Miramonte Elementary School. The alleged incidents occurred between 2008 and 2010 and involved boys and girls at the school, whose ages were between seven and 10 years.</p>]]>
        <![CDATA[<p>According to the <a href="http://www.latimes.com/">Los Angeles Times</a>, Berndt had been a teacher at the school for three decades and had no prior history of arrest. The charges against him are sex crimes are considered to be serious felonies. If convicted, Berndt will be forced to register as a sex offender. The article does not say if Berndt has hired a <a href="http://www.danielperlmanlaw.com/Sex-Crimes/">Los Angeles sex crimes defense lawyer</a> yet.</p>
<p>Law enforcement began to investigate Berndt almost a year ago after a photo processor turned over pictures to the Los Angeles Sheriff's Department. The photographs, which were also recovered from Berndt's home, are said to show images of children tied up and blindfolded, with Madagascar hissing cockroaches climbing on them.</p>
<p>Other photos depicted girls holding blue spoons containing a white substance near their mouths. Authorities believe the substance is Berndt's semen. Investigators believe the girls were forced to ingest it.</p>
<p>In early January of last year, law enforcement notified the school district about Berndt's suspected <a href="http://www.danielperlmanlaw.com/Sex-Crimes/">sex crimes</a>. Berndt was removed from his classroom immediately and subsequently fired.</p>
<p>In total, over 400 images have been recovered. Some of the alleged victims have yet to be identified. Berndt is currently being held in jail. Bail has been set at $2.3 million.</p>

<p>Federal authorities reported seizing over $4 million worth of counterfeit goods in Los Angeles as part of a six-week sting operation titled, "Operation Holiday Hoax." The worldwide operation was part of a collaborative effort between Homeland Security Investigations, the U.S. Customs and Border Protection, the U.S. Postal Inspection Service and the Consumer Products Safety Commission.</p>
<p>The goods that were taken were mainly apparel items with name brands such as North Face, True Religion and Nike. Globally the value of the goods seized during the operation was estimated at over $76 million.</p>
<p>Counterfeiting is common during the holiday season, but it is not confined to just goods alone. Law enforcement also sees an increase in counterfeit money during this time of year. Anyone suspected of counterfeiting in <a href="http://www.danielperlmanlaw.com/Federal-Crimes/Federal-Fraud-Crimes.shtml">Los Angeles will face federal fraud charges</a>.</p>]]>
        <![CDATA[<p><strong>Holidays Also Bring Rise in Use of Counterfeit Money</strong></p>
<p>The flurry of activity during the holidays makes it attractive to counterfeiters. Store clerks overwhelmed by the deluge of shoppers are less likely to catch counterfeiters. Tourist destinations, like Los Angeles, which have a large number of people passing through the city daily make it an attractive location for would be counterfeiters.</p>
<p>The U.S. Secret Service advises shoppers to be on the lookout as well. Frazzled store clerks are just as likely to pass counterfeit money back to them. U.S. currency should be sharp with bold crisp lines that make the images stand out on the paper. Even the paper itself is distinctive. It is made with blue and red fibers woven into it.</p>
<p>Counterfeiting is not always done by a skilled operation with sophisticated printing presses in other countries. Sometimes counterfeit bills are created on a home printer.</p>
<p>Anyone suspected of manufacturing false currency, selling counterfeit goods or passing counterfeit money, could be charged with a <a href="http://www.danielperlmanlaw.com/Federal-Crimes/Federal-Fraud-Crimes.shtml">federal fraud crime</a>. These kinds of charges bring consequences. A person convicted of counterfeiting may be subject to substantial fines as well as prison time.</p>

        <![CDATA[<p><strong>California Governor Fails to Protect Privacy Interests</strong></p>

<p>This month, Governor Jerry Brown balked at the opportunity to pass a bill that would shield Californians from invasive searches of cellphones. Citing a reluctance to overrule the decision made by the California Supreme Court in January - that determined a warrant was not necessary before searching a cellphone collected during an individual's arrest - the governor left the door open to police invasion into the private lives of Californians.</p>

<p>The Supreme Court case, <em>People v. Diaz</em>, drew an outrage from civil rights advocates and <a href="http://www.danielperlmanlaw.com/" target="_blank">criminal defense attorneys</a> who argued that smartphones, unlike other pieces of personal property such as cigarette packages and clothing, can hold vast amounts of information. The court reasoned that the cellphone's immediate association with the defendant made the police search of the cellphone valid.</p>

<p>Lawmakers agreed with privacy advocates and introduced legislation that would require a warrant before <a href="http://www.danielperlmanlaw.com/Criminal-Defense-Overview/Drug-Crimes.shtml" target="_blank">searching a cellphone seized during an arrest</a>. The bill swept through the legislature with unanimous approval before being stomped on by the governor.</p>]]>
        <![CDATA[<p><strong>Courts Interpret the Law - They Do Not Create It</strong></p>
<p>The governor gave a weak statement to <a href="http://www.cnn.com/">CNN</a> justifying his decision, "The courts are better suited to resolve complex and case-specific issues relating to constitutional search-and-seizure protections." The governor's response relays a fundamental misunderstanding of the origins of legal protections.</p>
<p>Courts have always existed to uphold the law, but they do not create it. While individual states are not at liberty to strip federal constitutional protections, they may enact legislation to provide greater protections to its people. Where there is ambiguity in the law, courts interpret it as it is written.</p>
<p>Legislators were simply trying to provide the teeth necessary to protect Californians from broad and sweeping searches into their personal lives. The veto permits police to search all of the information contained within a cellphone, including search history, chat logs, all application data, address books and call logs.</p>
<p>The United States Supreme Court rejected a petition to hear the Diaz case on October 3<sup>rd</sup>. California legislators must wait a year before introducing the legislation for a second time.</p>
